Benu litigates high-stakes intellectual property cases in courts across the country, from inception through trial and appeal.

Biography

Benu represents clients in patent and other complex commercial litigation in federal district court and the U.S. Court of Appeals for the Federal Circuit.  In patent litigation, Benu represents both innovators seeking to enforce their patent rights and companies defending against allegations of patent infringement across various technology sectors, including the semiconductor, software, telecommunications, pharmaceutical, medical device, electronics, chemical, and consumer product industries.  She has represented both patentees and generic pharmaceutical manufacturers in litigations under the Hatch-Waxman Act.

Benu excels at developing proactive strategies to steer complex cases to victory, drafting incisive briefing to dispose of cases before incurring the expense of trial, and communicating technologically complex subject matter in straightforward terms to stakeholders, judges, and jurors.

Experience

Seasoned in taking patent infringement and false advertising cases to trial, Benu has obtained significant monetary and injunctive relief on behalf of clients.  For instance, she secured patent infringement verdicts and damages totaling over $50 million in two jury trials on behalf of a NASDAQ-listed cybersecurity company enforcing its proprietary threat detection and prevention technology.  And Benu has disposed of numerous cases and claims before trial, including dismissal of a false advertising claim for lack of personal jurisdiction over an international pharmaceutical manufacturer, dismissal of a satellite radio provider for improper joinder in a patent infringement action, and denial of a motion for a temporary restraining order in a patent infringement action against a large pharmaceutical company.

Prior to joining Gish PLLC, Benu served as Special Counsel in the Intellectual Property group of an elite national law firm, where she led the Working Parents Affinity Group and served on the firm’s Diversity and Inclusion committee.

Benu also has dedicated significant time to pro bono work, including obtaining asylum for a female Afghani civil rights advocate and assisting women living in poverty in need of divorce.
